3. Use of the Service The Service provides a browser-based platform to edit, sign, and manage PDF files online — including adding/removing text and images, rearranging pages, filling forms, applying electronic signatures, merging/splitting files, compressing, and converting formats. You are granted a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use. You retain all rights and ownership of your Content.
4. Third-Party Services The Service may display third-party content. The Company does not endorse or assume responsibility for any Third-Party Services or Materials. Any engagement is at your own risk.
5. Subscription Fees and Payment All subscriptions automatically renew unless canceled at least 24 hours before the renewal date. Cancellation must be completed through account settings or by contacting support@pdfkitai.com. Purchases are generally non-refundable unless otherwise stated.
Note for EU Citizens: You have 14 days to withdraw from a contract without reason. Email support@pdfkitai.com to exercise this right. If you provided prior express consent to begin performance during the withdrawal period, you may not be eligible for a full refund on digital content.
If you wish to request a refund, please contact us before initiating a chargeback. Initiating a chargeback may result in immediate account termination.
6. User Restrictions You agree not to scrape data, reverse-engineer, circumvent security features, distribute malware, or use the Service for unauthorized commercial purposes.
7. Disclaimer of Warranties THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED.
8. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU SHALL BE LIMITED TO THE TOTAL AMOUNT PAID BY YOU DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100.
9. Indemnification You agree to defend, indemnify, and hold harmless the Company from any losses, damages, or claims arising from your Content, breach of these Terms, or violation of applicable laws.
10. International Use You access the Service at your own initiative and are responsible for compliance with local laws.
11. Arbitration All disputes shall first be addressed
through good-faith informal negotiations for at least sixty (60) days. To

If the dispute is not resolved within sixty (60) days, it shall be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration shall be governed by the U.S. Federal Arbitration Act and may be conducted remotely or in the county where you reside.
Either party may bring an eligible claim in small claims court.
CLASS ACTION WAIVER: To the fullest extent permitted by law, you and the Company waive the right to a jury trial and agree to resolve disputes only on an individual basis, not through any class, collective, consolidated, or representative action.
12. Governing Law These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
Nothing in these Terms affects any mandatory consumer protection rights available under the laws of your place of residence. For EU/EEA and UK residents, applicable mandatory consumer rights remain unaffected.
Any dispute not subject to arbitration shall be heard in the state or federal courts located in Delaware, except where applicable consumer law provides otherwise.
13. Miscellaneous These Terms constitute the entire agreement between you and CLOUD WHALE INTERACTIVE TECHNOLOGY LLC, a Delaware limited liability company, regarding the Services.
If any provision is found invalid or unenforceable, the remaining provisions will continue in effect. Failure to enforce any provision shall not constitute a waiver.
